Terms of Use

These Terms of Use ("Terms") govern your use of the Act mobile application ("App") operated by MintyGum LLC ("we", "us", "our"), a Delaware limited liability company. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of Service

Act is an AI-powered photo and video generation app. You upload photos, select from pre-made templates, and our AI generates new photos or videos featuring your likeness. The App operates on a subscription and credit-based model.

2. Eligibility

You must be at least 13 years old (or the applicable age of consent in your jurisdiction) to use the App. By using the App, you represent that you meet this age requirement.

3. Account & Identity

The App does not require account creation or login. Your identity is based on an anonymous device identifier generated and stored locally on your device. You are responsible for maintaining access to your device. If you delete the App or lose your device, your anonymous identity and associated data (including your credit balance and library) cannot be recovered.

4. Subscriptions & Credits

Subscription Plans

The App offers weekly auto-renewable subscriptions (Basic, Gold, Elite) that provide weekly credit allocations. Subscriptions are billed through Apple App Store or Google Play Store.

Free Trial

New users may be eligible for a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid weekly plan.

Credits

Credits are the in-app currency used to generate content. Each template has a credit cost. Weekly credits from subscriptions reset each billing cycle and do not roll over. Bonus credits purchased as one-time packs do not expire.

Credit Packs

One-time credit packs are available for purchase and are non-refundable. Bonus credits persist across subscription changes and never expire.

Refund Policy

Subscription and purchase refunds are handled by Apple or Google according to their respective refund policies. We do not process refunds directly. If an AI generation fails, the credits spent on that generation are automatically refunded to your balance.

Cancellation

You can cancel your subscription at any time through Apple App Store or Google Play Store settings. Cancellation takes effect at the end of the current billing period. You retain access to your credits and content until the subscription expires.

5. Acceptable Use

You agree not to: upload photos of other people without their consent; upload photos of minors; use the App to create deceptive, defamatory, harassing, or illegal content; use generated content to impersonate others or for fraud; attempt to reverse-engineer, hack, or abuse the App or its AI systems; use automated tools, bots, or scripts to access the App; circumvent any security or access restrictions; or resell, redistribute, or commercially exploit generated content in ways that violate third-party rights.

We reserve the right to suspend or terminate your access to the App if we determine, in our sole discretion, that you have violated these Terms.

6. Content & Intellectual Property

Your Photos

You retain ownership of the photos you upload. By uploading a photo, you grant us a limited, non-exclusive license to process it through our AI systems and third-party AI providers solely to generate the requested content.

Generated Content

You receive a non-exclusive, personal license to use, download, share, and post AI-generated content created through the App for personal, non-commercial purposes. We do not claim ownership of your generated content. However, due to the nature of AI generation, similar or identical outputs may be generated for other users using the same templates.

Templates

All templates, designs, and creative assets within the App are owned by MintyGum LLC or our licensors. You may not extract, copy, or redistribute templates.

App Content

The App's design, code, branding, and all associated intellectual property are owned by MintyGum LLC.

7. AI-Generated Content Disclaimer

Content generated by the App is produced by artificial intelligence and may contain imperfections, artifacts, or unexpected results. We do not guarantee the quality, accuracy, or suitability of any generated content. You are solely responsible for how you use and share generated content.

8. Data Retention & Content Deletion

Your generated content is stored on our servers while you maintain an active subscription. If your subscription expires and is not renewed, all your generated content will be permanently deleted from our servers after 14 days. This deletion is irreversible. We strongly recommend saving any content you wish to keep to your device before cancelling your subscription.

9. Third-Party Services

The App relies on third-party AI providers (including eachlabs.ai, fal.ai, Higgsfield, and Replicate) to generate content. We are not responsible for the availability, performance, or policies of these third-party services. Service interruptions by third-party providers may temporarily affect the App's functionality.

10. Limitation of Liability

To the maximum extent permitted by applicable law, MintyGum LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to: loss of generated content, service interruptions, AI processing failures, or unauthorized access to your device. Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 30 days preceding the claim.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated content will meet your expectations.

12. Indemnification

You agree to indemnify and hold harmless MintyGum LLC from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. We will make reasonable efforts to notify you of material changes.
